By downloading, accessing, or using FotoBoom ("the app"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

The Service

FotoBoom provides AI-powered photo transformation features. Results may vary and are not guaranteed to meet specific expectations.

Your Content

• You retain ownership of photos you upload
• You grant us a limited license to process your photos solely to provide the service
• You confirm you have the rights to any photos you upload
• You must not upload photos of others without their consent

Prohibited Uses

You agree NOT to use FotoBoom to:

• Create content depicting minors inappropriately
• Generate illegal, harmful, or deceptive content
• Impersonate real individuals without their consent
• Engage in fraud, scams, or misleading activities
• Attempt to reverse-engineer, hack, or abuse the service
• Violate any applicable laws or regulations

Purchases & Subscriptions

• All purchases are processed through Apple's App Store
• Subscription credits refresh each billing period and expire if your subscription lapses
• Purchased credit packs never expire
• Refunds are handled according to Apple's refund policies
• We reserve the right to change pricing with reasonable notice

Intellectual Property

• FotoBoom and its features, design, and technology are our property
• Images you generate are yours to use, subject to these terms
• You may not use generated content for illegal purposes

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that results will meet your expectations.

Limitation of Liability

To the maximum extent permitted by law, FotoBoom and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate your access to the service at any time for violations of these terms or for any other reason at our discretion.

Changes to Terms

We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the updated terms.

Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
